Although SBA’s determination of what is an affiliate may differ than the lender’s definition, affiliation still matters for several reasons, including size, amount of available SBA guaranty authority and the possible impact of an affiliate on the applicant’s repayment ability. Additionally, lenders are seeing more applicants operating in non-traditional ways from home-based businesses, vacation rental entities, internet sales, shared spaces and more, making it difficult to determine eligibility. This session will discuss these important topics plus provide real life examples of applying affiliation rules and scenarios that distinguish an active eligible business from a passive business ineligible for 7(a) financing.
